4.  Buying products

The purchase of products through an online order is made in compliance with the following conditions:

6. Registering and confirming an order

By placing an order (electronically or by telephone) through the online store, the Buyer agrees with the form of communication through which the Seller carries out its operations (electronically or by telephone).

An order consists of the following:

  • goods or services found in the offer of the online store mentioned above;
  • clear information on invoicing, delivery and other special information;
  • buyer's specifications.

Placing an order (electronically or by phone) does not require confirmation of the order and the contract. The complete steps are as follows:

  • registration of an order: an automatic unique number will be generated for each registered order;
  • taking over an order by a sales agent, within the working hours displayed on the site in the CONTACT section;
  • concluding the contract representing the moment of issuing fiscal invoices on a durable or electronic support;
  • the delivery of an order is made after the confirmation of the order and after the establishment of the delivery details by the sales or delivery agent and by the Buyer.

The messages sent automatically by the system do not confirm the existence of the product in stock nor the conclusion of the Sale-Purchase contract.
Orders are taken/registered and only after confirmation from the supplier regarding the availability of the product in stock, orders are accepted and honored.

Note: Orders containing a Gift Card and Extended Warranty (independently) will not benefit from additional discounts, such as: vouchers, anniversary discounts, Corporate discounts, etc.

7.  Price and stock of products

Product prices and stock are updated from 24 hours to 5 days. Prices for orders and proforms are valid for 3 days from the date of their issuance.
For products that are brought on a special order basis, an advance of at least 30%-50% of the value of the product can be requested.
If the prices or other details regarding the products have been displayed incorrectly ("derisory price", art. 1665 para. 2 of the New Civil Code), including due to the fact that they have been entered incorrectly in the database, we assign the right to CANCEL orders containing these products and to notify customers as soon as possible about the error.
The stock of products sold by the online store is mentioned as follows:

  • STORE STOCK: the product is in physical stock (WITHIN THE AVAILABLE STOCK) and can be delivered based on an online order, AFTER ORDER CONFIRMATION (Acceptance of the order). Orders for products with STOCK STORE status will be honored in the chronological order in which they are recorded in the database. All products displayed with STOCK STORE status have a limited number of pieces. The stocks are updated according to the above - consequently there may be situations in which a product ordered with STOCK STORE status becomes unavailable if it has been confirmed on a previous order.
  • ONLINE EXCLUSIVE STOCK: the product (s) in EXCLUSIVE ONLINE stock are available in limited quantities (WITHIN THE AVAILABLE STOCK). The order will be accepted after confirmation of the quantity available in the supplier's stock by the sales agent. The stock is updated at the supplier at an interval of up to 15 days from the moment of taking the order. In case the product is no longer in the supplier's stock, the Buyer will be informed about this aspect. Because the supplier's inventory is not updated within an interval that allows accurate information, there may be cases where a product displayed in the supplier's stock is no longer actually in stock. It is also possible that these products can only be brought on special order, with delivery times from 2 days to 60 days. As the information is taken from the supplier, we do not assume responsibility if the product is not in stock.
  • QUEST STOCK: the product requires manual verification of the stock, the product is still in the offer of suppliers, the products can be brought on special orders from the car manufacturere have a delivery time of 2 to 60 days (confirmation of the delivery time is made by the supplier) or even the lack of stock with an indefinite replenishment period. The stock check at the supplier is made within a maximum of 5 working days from the moment of taking the order.
  • UNAVAILABLE: the product is no longer available in the Seller's stock or in the supplier's stock. This information is displayed for products that have been in stock and will not be brought back until they disappear from all offers of suppliers that works with.
  • SOLD OUT: The product is not in stock at or in supplier stock.
  • PREORDER: the product is only available in the PREORDER booking system. The manufacturer reserves the right to change, without notice, the release date and price of the product.

The products in the offer of the online store can be sold only on the basis of an order. The order will be processed according to the steps mentioned above during the work schedule of the Sales Department. An unconfirmed order does not require a reservation of the products. Orders will be honored in the chronological order in which they were recorded in the database. An order containing products displayed on the site with the following status: STORE STOCK, SUPPLIER STOCK (WAREHOUSE) OR ASK FOR STOCK cannot be honored if another order has been registered on the same product before it chronologically and subsequently confirmed , thus depleting the stock.

8.  Silver

The buyer will pay the value of the products ordered by cash on delivery, bank transfer or online by card. The ordered products remain the property of the Seller until the full payment of the payment amounts.
If payment is made by bank transfer, the transfer costs are borne by the Buyer. The date of payment is considered to be the date on which the money entered the Seller's account. The bank account number is sent to the buyer in an e-mail together with the order confirmation and a proforma invoice. Always check that you make the payment in the indicated bank account. The Seller does not assume any responsibility in case the Buyer makes the payment in another bank account than the one mentioned in the proforma invoice.

The amounts paid by online payment, by bank card, will be automatically blocked on the Buyer's account, by the payment processor, and automatically directed to the bank account of (SC Smart Axis srl), within approximately 72 hours . We would like to point out that this process is done automatically, without the intervention of any employee of (S.C. Smart Axis s.r.l.). Order confirmation will be made after verification and confirmation of receipt. Interchange fee
For customers who pay with a business/professional/corporate card or issued in countries outside Romania, an interchange fee of 2% of the order amount will be applied. The fee is set by Visa and Mastercard and charged according to the algorithm created by them. You can find more details on the official Visa and Mastercard websites.
As we want to offer you competitive prices, we offer you the solution to pay with a payment order, in which case this fee will not be charged. If you choose to pay online for one of these types of cards (business / professional / corporate or issued by a bank outside Romania), the interchange fee will be added to the placed orders. In the event that the fee will not be charged automatically, when placing the order, (S.C. Smart Axis s.r.l.) reserves the right to subsequently invoice this fee. 9.  Delivery of products

In the case of deliveries by courier (S.C. 10.  Product warranty

All products sold by the online store, except for the resealed ones, benefit from warranty conditions according to the legislation in force and the commercial conditions of the manufacturers and distributors - all products are new (except the resealed ones), in original packaging. The warranty of products sold by is provided by the authorized services of distributors or manufacturers, by handing them over in case of non-compliance, to the warranty collection center or directly to the authorized service centers specified in the warranty certificate. .

The warranty cannot be invoked in the event of improper or incorrect use of the product. 11.  Return conditions

The return of the products is subject to the laws in force as well as its own return policy in some cases.
According to the Romanian legislation in force, the Individual Buyer has the right to notify the Seller in writing that he renounces the purchase, without penalties and without invoking a reason, within 14 days of receiving the product.

The return of the products in order to be redirected to the services authorized/approved by the supplier/distributor/manufacturer will be made respecting the indications of the return procedure (packaging, storage, handling of transport cost).

The sender is responsible for the correctness of the data entered on the transport document (AWB) as well as for the correct packaging and labeling of packages.
The packages sent by the sender must be packed in a way that protects the product from factors that could lead to its deterioration during transport (it is recommended to use safety elements, eg polystyrene, cardboard, air bubble foil, etc). It is also recommended to pack the package so that it corresponds to the weight, shape and nature of the contents, as well as the mode and duration of transport.
The packaging must protect the contents so that it cannot be damaged by pressure or successive handling, and may, where appropriate, be made of cardboard, plywood, wood, polystyrene-filled plastic.

14.  Seller's liability

The seller does not assume responsibility for display errors, in terms of prices, features, pictures, etc. In the event that the price of the product or some of its features are incorrectly listed in our database, we reserve the right to cancel the delivery of that item and to notify the Buyer as soon as possible about the error. Waste electrical and electronic equipment (WEEE) may contain hazardous substances that have a negative impact on the environment and human health if not collected selectively.

Considering the provisions of GEO 195/2005 - regarding the protection of the environment, GEO 78/2000 - regarding the waste regime, based on the provisions of art. 10 of H.G 448/2005, regarding waste electrical and electronic equipment, the Buyer will take into account the following:

  • the buyer has the obligation not to dispose of waste electrical and electronic equipment (WEEE) as unsorted municipal waste and to selectively collect this WEEE;
  • collection of this waste (WEEE) will be carried out through selective collection points provided by local public administration authorities who have the obligation according to art.5 paragraph 1) of GD 448/2005 to collect WEEE separately from private households and to make available to producers the space necessary for the establishment of WEEE collection points;

According to art.11 of GEO no.5 of 16.04.2015, upon supply of a new product, at the request of the Buyer, the Seller may take over WEEE (Electrical and electronic waste) in the system "one by one", free of charge, under the same conditions as those of delivery of the new product, if the equipment is of an equivalent type and has fulfilled the same functions as the new product supplied.

17.  Fraud
